Terms and Conditions
Chiasson & Fils Landscaping Inc.
Article 1 – Purpose
The purpose of these General Terms and Conditions of Sale (GTC) is to define the terms and conditions under which Chiasson & Fils Landscaping Inc., a company specializing in landscaping, provides its services to its individual and professional clients.
Article 2 – Acceptance of Terms and Conditions
Any order for services implies unconditional acceptance of these GTC, which prevail over any other client document, unless specific conditions are expressly accepted in writing.
Article 3 – Services Offered
Chiasson & Fils Landscaping Inc. offers services including, but not limited to:
– Design and construction of exterior landscaping
– Planting of trees and shrubs
– Earthworks, paving, low walls, and borders
– Seasonal landscape maintenance (pruning, cleaning, snow removal)
*The details of the services are specified in the quotes or proposals provided to the client.
Article 4 – Orders and Quotes
All requests result in a written quote, valid for 15 days. The order becomes firm upon receipt of written acceptance of the quote by the client, by signature or email, accompanied by a required deposit. The start of work is subject to team availability and weather conditions.
Article 5 – Rates and Payment
Prices are expressed in Canadian dollars, excluding taxes.
– A deposit of 50%-100% of the total amount may be required upon signing the contract.
– The balance is due upon completion of the work, unless otherwise stated in the quote.
*Any late payment will result, without prior notice, in late payment interest at the legal rate, as well as a fixed penalty for recovery costs or a lien on your property.
Article 6 – Deadlines and Execution
The start and completion deadlines for work are provided for informational purposes only. They may be modified for reasons beyond the company's control, such as weather conditions, material delivery times, or unforeseen events on the construction site but not limited to. No compensation may be claimed for these delays.
Article 7 – Modifications and Unforeseen Events
Any changes to the project after the quote has been approved will result in a price revision. In the event of unforeseen site conditions (e.g., the presence of rock, unstable soil, unlocated pipes etc. but not limited to), Chiasson & Fils Landscaping Inc. will propose a price adjustment to the client for approval before continuing work. This adjustment must be accepted for the remainder of the project.
Article 8 – Complaints
All complaints must be made in writing within 7 days of the completion of the work. Otherwise, the services are deemed compliant and accepted.
Article 9 – Liability
Chiasson & Fils Landscaping Inc. undertakes to perform its services according to industry standards.
It cannot be held liable for damage caused:
– by misuse or poor maintenance by the client;
– by extreme weather conditions or unforeseeable events (e.g., flooding, frost, drought, etc. but not limited to).
Article 10 – Warranty
The plants supplied are guaranteed for one growing season, subject to proper watering and maintenance by the client. Other works (paving, low walls, structures, etc.) are guaranteed for 12 months from the completion date against any defects.
*Some materials used may, however, be covered by a longer manufacturer's warranty, depending on the specific conditions of each product.
Article 11 – Personal Data
The data collected is used strictly for order management and customer relations. The client may, at any time, request access to, modification of, or deletion of their data in accordance with applicable legislation.
Article 12 – Applicable Law and Jurisdiction
These General Terms and Conditions are governed by the laws of the province of New Brunswick.
*Any dispute relating to their interpretation or execution, failing amicable resolution, shall be submitted to the competent courts of the judicial district of the registered office of Chiasson & Fils Landscaping Inc.
Upcharge Clause,
Should additional work not provided for in the initial contract be required or requested by the client during the project, an upcharge may be applied. This upcharge will be assessed based on the additional time, materials, and resources required. No additional work will be undertaken without the client's written or verbal approval, including acceptance of the estimated upcharge.
